A motion hearing has been set for May 20th in a Louisiana couple’s wrongful death lawsuit against the city and a landlord.
Ryan and Catherine Miller are seeking damages and court costs after a fire that claimed the life of their three-year-old son, Riley Rieser Miller.
He died of smoke inhalation secondary to carbon monoxide poisoning in the blaze at his family’s home near downtown Louisiana on Oct. 31st 2013.
The Millers filed the lawsuit on March 12th of this year. The couple alleges police used electroshock weapons to keep Ryan Miller from re-entering the burning house to retrieve his son. They also claim the landlord, Louis Houston of Elsberry, allegedly knew the home was unsafe.
An investigator ruled the fire accidental due to a faulty electrical circuit and said there were no signs of arson or foul play.
