A former Vandalia man originally charged in the theft of an all-terrain vehicle is now accused of threatening the Pike County prosecutor.
Forty-eight-year-old Vincent Breyfogle of Stoutsville is charged with felony tampering with a judicial officer.
The suspect is accused of threatening to harm Pike County Prosecuting Attorney Mark Fisher while on a call to the National Suicide Prevention Lifeline in October.
Breyfogle allegedly admitted to authorities he told the hotline he was homicidal, not suicidal. A deputy reported in a probable cause statement that the suspect later said he didn’t mean to kill Fisher but hurt him as emotionally as he had been by the arrest in ATV theft.
The vehicle was stolen from a repair shop southwest of Bowling Green on May 12th of last year. Another person charged in the case pleaded guilty to felony theft and was sentenced to five years of probation.
In September, Breyfogle entered an Alford plea – which means he did not acknowledge guilt but admitted there was sufficient evidence to convict him if the case went forward.
Court records show that he has now withdrawn that plea and applied for a public defender in the case, which is scheduled for a court hearing January 25th. No date has been set for an appearance on the tampering charge.
All persons charged with a crime are presumed innocent until convicted in a court of law.
